Terms and Conditions
1.4 As the number of participants in each training measure is limited, registrations will be processed in the order in which they are received.
2.5 Training measures are generally conducted with a minimum of 8 participants. The maximum number of participants is typically 16 people. Deviations are reserved. The number of participants is determined by the seminar program.
2.6 The registration deadline is usually 10 working days before the event.
2.7 It is explicitly pointed out that for participation in certain training measures, the participant must meet certain basic prerequisites. In such cases, these prerequisites will be listed in the seminar program.
3. Prices
3.1 The prices of the seminar program valid at the time of registration apply. The price for a training measure, unless otherwise expressly stated in the program description, covers only the cost of the event, all materials, documents, handouts, and participation certificates, plus the applicable statutory VAT. Not included are any travel costs, accommodation, and meals of the participant, unless otherwise expressly stated in the program description.
3.2 If the duration or content of the training is changed, Schreibmotorik Institut e.V. reserves the right to adjust the prices, which must be agreed upon in advance with the participant.
3.3 Partial participation in a training measure, arriving late, or leaving early does not entitle the participant to a price reduction.
4. Payment Terms
4.1 The fees are due for payment within 10 days without any deductions after the registration is accepted and the invoice has been sent to the participant.
4.2 The invoice is issued after the event/service provision to the participant.
4.3 The invoice can be issued electronically (e.g., by email).
5. Training Services and Lecturer Engagement
5.1 Schreibmotorik Institut e.V. reserves the right to replace announced lecturers/trainers with equally qualified substitute lecturers/trainers for all training measures. Additionally, Schreibmotorik Institut e.V. reserves the right to make changes to the date and location of the event, with prior notice. In such a case, the participant has the right to cancel without cancellation fees within 7 calendar days after receiving the notice via mail or email.
6. Tailored Training
6.1 At the participant's request, Schreibmotorik Institut e.V. will conduct tailored training measures. These training measures require a separate contract. Upon request, Schreibmotorik Institut e.V. will clarify the necessary conditions for the training and prepare a written offer. The participant must confirm the offer within the specified deadline by post or email.
6.2 Prices and services for tailored training are agreed upon individually in the contract.
7. Participant's Right to Cancel / Deadlines
7.1 The cancellation of a training measure by the participant must be made by post or email.
7.2 Cancellation is free of charge up to 30 calendar days before the start of the training. For cancellations or postponements received less than 30 calendar days before the start of the training, 50% of the training price will be charged. For cancellations within the last 14 calendar days before the start of the training or in the case of no-show, the full price will be charged. The decisive factor is the receipt of the cancellation by Schreibmotorik Institut e.V.
7.3 The participant may name a suitable replacement participant at any time without incurring any fees.
8. Right of Withdrawal for Consumers in Distance Contracts
8.1 In distance contracts concluded exclusively using means of remote communication (e.g., email), consumers within the meaning of Section 13 of the German Civil Code (BGB) can withdraw from the contract within 14 days from the day of the contract conclusion without giving reasons by submitting a clear declaration (e.g., a letter sent by post or email). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or self-employed professional activity.
8.2 In the case of an effective withdrawal, the services received by both parties must be returned within 14 days at the latest.
8.3 The right of withdrawal expires prematurely if Schreibmotorik Institut e.V. has completely provided its service and the service was started only after the consumer had given explicit consent and confirmed their awareness that they lose their right of withdrawal once the contract is fully performed.
9. Right of Withdrawal of Schreibmotorik Institut e.V.
9.1 Schreibmotorik Institut e.V. can withdraw from the contract if the minimum number of participants required for the event type or project is not reached, if the event must be canceled due to illness of the trainer/lecturer, or for reasons beyond the control of Schreibmotorik Institut e.V. Schreibmotorik Institut e.V. will attempt to reschedule the registrations to another date or location, provided this is possible and approved by the participant.
9.2 Schreibmotorik Institut e.V. has the right to withdraw if the participant or a participant violates the terms and conditions.
10. Copyright
10.1 Schreibmotorik Institut e.V. reserves all rights to reprint and reproduce participant materials, video clips, and project and action documents. No part of the participant materials, a lecture, or project and action materials may be reproduced, duplicated, distributed, or used for public presentations without prior written permission. Violations may lead to claims for damages.
10.2 The transfer of copyrights for training and seminar materials or project and action materials to the participant requires a separate contractual agreement.
11. Data Protection
11.1 Detailed information on the type and scope of data processing is available in printable form under the "Privacy Policy."
12. Safety
12.1 Participants are required to follow the instructions of the lecturers/trainers during events. Additionally, the house rules and safety regulations applicable at the respective training location must be observed.
12.2 Schreibmotorik Institut e.V. is not responsible for loss or damage to items brought by participants.
13. Participation in Actions or Projects of Schreibmotorik Institut e.V.
13.1 For participation in actions or projects, Schreibmotorik Institut e.V. may set separate regulations.
13.2 For participation in actions or projects of Schreibmotorik Institut e.V., the following additional regulations apply:

Type of participation: Participants can generally participate through donations, project sponsorship, or active involvement.

Process of the action or project in case of active participation by the participant: a) The process of the action or project is outlined in the informational materials of Schreibmotorik Institut e.V. related to the respective action or project. b) If applicable, the participant is responsible for initiating and executing the action or project with a facility they choose. Schreibmotorik Institut e.V. assumes no liability for the execution of the project at the facility selected by the participant. c) The participant may not use the project for the sale of their products. In case of misuse, the participant may be excluded from the action or project. d) The participant may use the name "Schreibmotorik Institut e.V." or the logo only in connection with the action or project and only with prior approval from Schreibmotorik Institut e.V. Schreibmotorik Institut e.V. reserves the right to withdraw the consent to use its name or logo at any time.
14. Liability
14.1 The concept of Schreibmotorik Institut e.V. does not constitute psychotherapy. Participation in training measures is voluntary and at the participant's own responsibility. Schreibmotorik Institut e.V. assumes no liability for the intended success of the training measure and/or any intended approval for exams and/or passing such exams, of any kind.
14.2 Claims for damages are excluded, except for claims arising from injury to life, body, health, or violation of essential contractual obligations (cardinal duties), as well as liability for other damages resulting from intentional or grossly negligent breach of duty by Schreibmotorik Institut e.V., its legal representatives, or agents.
14.3 Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract. In case of violation of essential contractual obligations, Schreibmotorik Institut e.V. is only liable for the typical foreseeable damage, provided it was caused by gross negligence or intent, unless it concerns claims for damages resulting from injury to life, body, or health.
14.4 In case of withdrawal from the contract as per section 9, or if a training measure is canceled due to illness, force majeure, or other circumstances not attributable to Schreibmotorik Institut e.V., there is no entitlement to the execution of the event. Schreibmotorik Institut e.V. is not responsible for travel and accommodation costs or any costs arising from lost work or lost profits.
15. Invalidity of One or More Provisions
15.1 If one or more provisions of these General Terms and Conditions are completely or partially legally ineffective, the validity of the remaining provisions is not affected. The invalid provision will be replaced by a regulation that most closely approximates the intended purpose.
16. Alternative Dispute Resolution, Online Dispute Resolution Platform, Dispute Resolution Procedure under Section 36 of the Consumer Dispute Resolution Act
The European Commission has provided a platform for online dispute resolution (ODR). The link to this platform is: http://ec.europa.eu/consumers/odr. Schreibmotorik Institut is not obligated to participate in a dispute resolution procedure before a consumer arbitration board and cannot offer the participant such participation.
17. Jurisdiction and Applicable Law
17.1 The law of the Federal Republic of Germany exclusively applies. The application of the UN Sales Convention is excluded. The contractual language is generally German. For the contract conclusion, both German and English languages are available.
17.2 The place of jurisdiction for all disputes arising from the contractual relationship between the participant and Schreibmotorik Institut e.V. is the location of Schreibmotorik Institut e.V., provided the participant is a merchant, a legal entity under public law, or a special fund under public law.
17.3 These General Terms and Conditions apply from January 1, 2025.
